Chapter 13

Another form of personal bankruptcy filing is Chapter 13. Unlike Chapter 7, which is a liquidation of assets, Chapter 13 is a reorganization bankruptcy. Under a Chapter 13 plan, the debtor agrees to pay a certain percentage of his debt back to his creditors. The plan must be approved by the Trustee and typically last 3 to 5 years depending on the Debtor’s income.  A Debtor may choose to file Chapter 13 for several reasons: Trying to save a secured asset (house, car) by catching up on arrears, having too high of an income, having too many assets, or having too much equity in property.
